TERMS AND CONDITIONS OF THE PORDATA WEBSITE
1. SCOPE AND PURPOSE
These General Conditions apply to visitors to this website and are intended to regulate the terms and conditions governing the provision of services (hereinafter called the Service) by FUNDAÇÃO FRANCISCO MANUEL DOS SANTOS, with registered office at Largo Monterroio Mascarenhas, n.º 1, 7.º piso, 1099 - 081 Lisboa, under sole registration and corporate tax no. 508 867 380, hereinafter called FFMS.
The Service consists of providing statistical information about Portugalvia https://www.pordata.pt/. This information is taken from Statistics Portugal, Eurostat and several other official and certified sources
Browsing the website means you have accepted these Terms and Conditions.
FFMS reserves the right to change these Terms and Conditions without prior notice. Any such changes will be posted on the https://www.pordata.pt/website.
2. RESPONSIBILITIES
1. This Website has appropriate levels of security. However, FFMS shall not be liable for any losses or damage that you and/or third parties may incur due to delays, interruptions, errors or suspension of communications that arise from factors beyond its control. This includes any faults or failures caused by the communications network or communications services provided by third parties, the computer system, modems, the connection software or any computer viruses or viruses as a result of downloading infected files or files containing viruses through the service, or any other properties that may affect your equipment. If the Service becomes unavailable due to any errors in access to this Website, FFMS shall not be liable for any losses or damage.
2. All data and information queries made through this Service are presumed to have been made by you, exempting FFMS from any liability arising from misuse or fraudulent use of the information obtained.
3. FFMS shall not be liable for any losses or damage caused by any misuse of the Service that is not directly attributable to it due to wilful misconduct or gross negligence.
4. FFMS is not liable for any losses or damage arising due to non-compliance or limited compliance with the Service when this is not directly or indirectly attributable to it due to wilful misconduct or gross negligence. In particular, it is not responsible for (i) errors, omissions or other inaccuracies related to information provided through the Service; (ii) damage caused by the user or third parties, including infringement of intellectual property rights, (iii) non-compliance or limited compliance resulting from the enforcement of legal decisions or decisions made by administrative authorities or (iv) non-compliance or limited compliance resulting from the occurrence of situations of force majeure, which are situations of an extraordinary or unpredictable nature, beyond the control of FFMS, such as fires, power cuts, explosions, wars, riots, civil insurrection, government decisions, strikes, earthquakes, floods or any other natural disasters or other situations beyond the control of FFMS that prevent or hinder compliance with the obligations undertaken.
5. FFMS cannot guarantee that:
1. The Service provided will be uninterrupted, secure and error-free or that it will work indefinitely;
2. The quality of any service and/or information obtained through the Service will meet any expectations you may have;
3. Any advice or information, whether verbal or written, that you may obtain from or through the Service will give rise to any guarantee that is not expressly mentioned in these Terms and Conditions.
6. The user understands that FFMS cannot, under any circumstances, be held liable for any damage incurred, including, but not limited to, loss of profits, data, content or any other losses (even if you have previously informed us of the possibility of such damage occurring), as a result of:
1. Using or being unable to use the Service;
2. Unauthorised access to or modification of personal databases.
3. OBLIGATIONS OF THE USER
1. You undertake:
1. To provide correct personal data and addresses; and
2. Not to use false identities;
2. If any of the data are incorrect or insufficient, the responsibility is yours, and FFMS is exempt from any liability. If you breach any of these obligations, FFMS reserves the right to block your access to the website and also not to allow you any future access to some or all services provided by FFMS.
4. PRIVACY AND PERSONAL DATA PROTECTION
1. FFMS guarantees the confidentiality of all the data you provide.
2. The personal data identified in the registration form as obligatory are indispensable to the provision of the information Service by FFMS. Any omissions or inaccuracies in the data you provide is solely and exclusively your responsibility and may give rise to the refusal by FFMS to provide the Service.
3. Your personal data will be processed and stored electronically and will be used by FFMS in the context of your contractual and/or commercial relationship and, if you have given your consent, to send out promotional communications that may be of interest to you.
4. Under the current legislation on personal data protection, you are assured, at no extra cost, of the right to access, rectify or delete your personal data, oppose their use, limit their processing and to portability of your data, for the purposes set out in the previous paragraph.
5. FFMS respects your privacy and the protection of your personal data. Any information collected on the website will be kept confidential and will not be transferred to third parties without your express prior consent.

5. INTELLECTUAL PROPERTY
1. The website is a registered website and the Service provided by the website itself is the responsibility of FFMS.
2. The user acknowledges that the Service contains confidential information and that it is protected by copyright and related rights, industrial property rights and other applicable legislation.
3. The user acknowledges that any advertising content that highlights, promotes or mentions any sponsor or advertiser is protected by copyright and related rights laws, industrial property laws and other property protection laws. Therefore, such content may only be used with the express authorisation of the holders of these rights.
4. The user undertakes to fully respect the rights referred to in the previous paragraph, particularly by refraining from engaging in any actions that could be in breach of the law or these rights, such as reproduction, marketing, transmitting or otherwise making content available to the public or any other unauthorised actions aimed at that content.
6. SERVICE SECURITY CONDITIONS
1. The user agrees to observe all applicable legal provisions, particularly not to engage in or encourage others to engage in unlawful acts or acts offensive to public decency, such as indiscriminately sending unsolicited communications (spamming) in breach of the provisions of the legislation applicable to personal data processing and to advertising communications through automatic calling devices. You must also respect the terms of use of the Service, under penalty of FFMS suspending or disabling the Service under the terms set out herein.
2. The user expressly acknowledges and understands that the IP network constitutes a public electronic communications network that may be used by several users and, as such, subject to computer overload. Therefore, FFMS cannot guarantee uninterrupted provision of the Service without loss of information or delays.
3. Nor can FFMS guarantee the provision of the Service in situations of unpredictable overload of the systems in which it is supported or of force majeure (situations of an extraordinary or unpredictable nature, external to FFMS and which are beyond its control).
4. In the event of interruption of the Service for reasons of unpredictable overload in the systems that support it, FFMS undertakes to resume normal operation as soon as possible.
7. SUSPENSION AND DEACTIVATION OF THE SERVICE
1. Irrespective of any prior or subsequent communication, FFMS may, at any time, and at its sole discretion, discontinue the provision of the Service and or part of the Service to one or all users.
2. FFMS also reserves the right to suspend or terminate access to the Service immediately if you do not comply with the conditions of use referred to in point 3, as well as others referred to in the Terms and Conditions;
3. The suspension or termination of the Service by FFMS, pursuant to the preceding paragraphs, does not entitle you or third parties to any compensation or other form of indemnification, and FFMS shall not be held liable or otherwise responsible for any consequences arising from the suspension or cancellation of the Service.
8. TECHNICAL SETTINGS
1. Without prejudice to the provisions of the following paragraph, FFMS may change the Service and/or the technical conditions under which it is provided, as well as the terms of use, at any time and shall inform you of such changes at least fifteen (15) days in advance.

9. COMMUNICATIONS
1. Whenever FFMS deems it necessary or convenient to optimise the browsing experience and/or improve connectivity conditions, it may remotely reconfigure network settings.
2. Without prejudice to the provisions of the following paragraphs, and bearing in mind the innovative nature of the Service and the technological developments that may arise, FFMS may change its technical settings whenever this proves appropriate in order to adapt to such technological developments.
3. FFMS does not guarantee that it will make any upgrades or improvements to the Service.
10. APPLICABLE LAW
Any conflict or dispute as to the interpretation of these Terms and Conditions shall be submitted to the competent Portuguese court.
